We don’t need no stinkin’ probable cause!

Police in Ohio are in the news this morning, setting up road blocks under the false premise they were drug checkpoints. But it’s okay folks, it’s all in your best interests and for your safety.

“Police in Cleveland suburb of Mayfield Heights recently posted large yellow signs along Interstate 271 that warned drivers that there was a drug checkpoint ahead, to be prepared to stop and that there was a drug-sniffing police dog in use.

There was no such checkpoint, just police officers waiting to see if any drivers would react suspiciously after seeing the signs.”

I have to wonder if the Ohio police got the idea from Homeland Security Secretary Janet Napolitano or if they came up with this all on their own. The TSA has been violating our 4th Amendment right at airports on a regular basis, so much so they’ve taken their method of infringement on the road; literally, setting up random road checkpoints on public roads.

I read an article dated October 25, 2011 at the TSA Blog, an official government disinformation location, attempting to reassure everyone the TSA wasn’t conducting random checkpoints on our highways and roads. Within the content of that article the TSA said, basically, we were just there advising, it was the Tennessee Police doing the actual infringement of your 4th Amendment rights. Well, actually here’s how they worded it:

“As part of an ongoing terrorism prevention and response program, the Tennessee Department of Safety and Homeland Security hosted a statewide exercise on October 18-20, 2011. TSA participated through its Visible Intermodal Prevention and Response program.

The exercise focused on improving the communications and operating relationships of state, local, and federal agencies when responding to any type of homeland security situation.

TSA VIPR personnel participated at multiple locations in the Tennessee exercise, supporting state and local personnel as they inspected vehicles to identify potential security threats.”

These folks, be they city, state or federal don’t seem to understand the importance of constitutional limitations placed on government; specifically the 4th Amendment.

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Many interpret the 4th Amendment to cover folks in their houses; but are unaware the same principle applies in all aspects of social interaction to include an individual walking down the street, driving in a vehicle or at your place of work.

Some folks link the right to be secure in your person from unwarranted searches with the right to protect yourself from physical harm. The general term for this legal thought process is known as the Castle Doctrine.

“A Castle Doctrine (also known as a Castle Law or a Defense of Habitation Law) is an American legal doctrine that designates a person’s abode (or, in some states, any legally-occupied place [e.g., a vehicle or workplace]) as a place in which that person has certain protections and immunities permitting them to, in certain circumstances, use force (up to and including deadly force) to defend against an intruder — free from legal responsibility/prosecution for the consequences of the force used.”

Over the years the Supreme Court has become less than certain how it rules on aspects of the 4th Amendment; their tendency has been to become more liberal as time moves forward; or should I have altered that to read, as time progresses?

“In 1979, (Delaware v. Prouse) the Supreme Court stated that, absent articulable and reasonable suspicion that a motorist is unlicensed or that an automobile is not registered, or that either the vehicle or an occupant is otherwise subject to seizure for violation of law, stopping an automobile and detaining the driver in order to check his driver’s license and the registration of the automobile are unreasonable.”

It would seem that up through 1979 the Supreme Court considered the 4th Amendment to be intact; holding that motorists could not be stopped randomly, that such stops were unreasonable.

Now jump forward to 1990 and notice the wording in the Supreme Court’s ruling on Michigan v. Sitz.

“Where society’s need is great and no other effective means of meeting the need is available, and intrusion on people’s privacy is minimal, checkpoints toward that end may briefly detain motorists.”

You shouldn’t have to have that translated into English; but for those who don’t understand America’s slide toward pure socialism then perhaps it should be noted that the rights of the individual are now secondary to the needs and desires of society as a whole.

Homeland Security and the TSA have managed to twist the arms at state and local levels to implement unwarranted searches of persons and vehicles under the pretext of protecting us from terrorists. You can find these goons setting up checkpoints at railway stations, draw bridges and ferry landings; but they are only following orders, that should make you feel so much better.

A year ago March a checkpoint was set up by police and they were able to detain my son’s wedding party prior to boarding a ferry from Bolivar peninsula to Galveston where everyone was dressed in their finery. They checked under the hood, went through the entire content of the car, passenger compartment and trunk. I’m so glad the oil stain on my daughter in law’s wedding dress was able to be removed, the oil stain from standing on the side of the road while these goons pretended to be looking for terrorist activity. No, this doesn’t make me angry; my level of dissatisfaction goes well beyond angry.

I’ve said it before; searches carried out randomly are grievous and oppressive as they support the idea that everyone is guilty until proven otherwise. Searches conducted without cause by a government official mean the search was conducted capriciously and had no merit other than curiosity.

The use of random checkpoints by police is a violation of the 4th Amendment. No amount of hiding behind the line, “but we were there only in the capacity of giving advice” or there was a “greater need for the safety of society involved”, will justify intrusions regardless of how minimal those intrusions may be.

Deliver Us From Evil: Black Professor Spews Hate

Lord, deliver us from evil. I was appalled hearing black University of Pennsylvania Professor Salamishah Tillet say during a panel discussion on MSNBC that pro-lifer’s opposition to late-term abortion is really about white power racism. http://www.youtube.com/watch?v=zmQSi5-ujW4

Minority birth rates are up. Nutty professor Tillet believes those who oppose white women killing their babies are fearful of a decline of “whiteness, white supremacy, white privilege”. It takes a pretty sick mind to find racism in desiring that women not kill their babies.

By the way, Americans aborts 4000 babies a day of which a disproportionate high number are black babies. Planned Parenthood was founded by racist Margaret Sanger to fix “the negro problem”. http://www.blackgenocide.org/sanger05.html

Liberal blacks like Professor Tillet and Democrat so-called advocates for black empowerment ignore the blatant racism of Planned Parenthood. Heck, they even cheer Planned Parenthood on. With friends like Professor Tillet, Obama and his Democrat posse, black America does not need enemies.

Meanwhile, ill-informed blacks keep looking over their shoulders, fearful of conservative Republicans.

The fact that a vast majority of blacks continue to vote Democrat confirms that blacks are still falling for liberals urinating on them and telling them it is raining. Whenever blacks recognize the smell of urine, liberal media and Democrats tell clueless blacks that racist Republicans are the source.

As a black conservative, I know Republicans are real friends of blacks, not Democrats who say blacks are too stupid to acquire a photo ID and have for decades replaced live-in fathers in black homes with government. Two truths were exposed during Professor Tillet’s remarkable chilling words on national TV. One: The visceral racial hate against whites that is pervasive, tolerated, created and nurtured in liberal academia. How many students have been influenced by this hate filled racist black professor at a cost of $50,000 a year tuition?

But folks, teaching students to hate whites, particularly white males, begins in middle school and probably earlier.

Around 15 years ago, a white friend said her son came home from middle school extremely upset in tears. The poor kid was devastated suffering with overwhelming guilt for being white after learning all the horrible things white men did to blacks, women and native Americans. His liberal agenda operative teacher actually implied that he should feel guilty.

Today, that same kid, my friends son, is a twenty-something year old zealous member of the Communist Party. He believes white males and Capitalism are the greatest sources of evil in the world. Yes, I do believe public school indoctrination contributed to this young white man’s self hatred and hate for his country.

A second truth exposed in the MSNBC panel discussion is the slavery of “political correctness”. I am sure at least one of the whites on the panel was thinking in response to Professor Tillet’s remarks, “this sista is crazy”. And yet, no one challenged Tillet’s outrageous proclamation. The white liberals on the panel knew their place. Political correctness rule 101 is whites are forbidden to challenge “liberal” blacks.

Now as for black conservatives, well it is open season on them. As a matter fact, white liberals get a gold star beside their name for every attack on a black conservative. White liberals are granted permission by fellow liberals to “freely” use the “n” word. I have been called a “stupid self loathing n—–” for loving my country, being proud to be an American and not viewing myself as a victim.

Professor Tillet has a history of promoting wacky, far-left and racist ideas. In a sane world, Professor Tillet would be fired. A white professor expressing similar ideas in reverse would have been long gone.

Tillet is paid to infect the brains of our youths while conservative thought is banned on most campuses. Whenever students successfully sneak in a conservative speaker, the guest speaker is physically attacked with pies thrown at them and worse during their speech.

Black pundits, comedians, actors and professors are permitted and even celebrated for making racist hate-filled comments about whites. Meanwhile, the slightest slip of the tongue that could possibly be interpreted as a racial slur against blacks has ended the political and professional careers of numerous whites. Such unfortunate whites are tarred and feathered in the mainstream media – forced to beg for forgiveness while humbly bowing and kissing the rings of Al Sharpton and Jesse Jackson. What a sickening visual.

Folks, Americans agree that racism is wrong which a majority have expressed by electing a black president. But somehow, black America is given a pass, allowed to be racist. This is wrong and evil. Racism should not be tolerated from whites or blacks.

The American education system is infested with hated-filled racists who hate America as founded. I am talking the likes of professors Salamishah Tillet and my friend’s son’s middle school teacher. Passively continuing to allow and fund their access to our precious kids is insane.

1st Amendment does have limits

There’s a captioned picture being circulated on Facebook which got my attention. Senator Chuck Schumer’s picture with a caption saying he believes there ought to be limits on 1st Amendment rights because no amendment is absolute.

Well, how about that; this might be one of the few times I agree with Sen. Schumer.

Now before you start throwing conservative grown tomatoes in my direction and while I still have my soap box to stand on, let me explain the rational behind such a statement.

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

Any discussion on rights requires an acceptance that rights come from God; something which the godless among us have a problem with. There is a neutral word, a word some folks prefer, an avoidance to the use of God; Natural rights, as if they were found embedded in the rich soil of America. I’m willing to forego the argument, at least momentarily, biting my tongue and swallowing the blood; but my original supposition stands, rights come from God and this understanding is necessary to proceed further.

My friend Steve Montgomery wrote on the subject several years ago, the God: Author of liberty.

“If . . . we admit that God is the source of all wisdom and understanding, we must admit that by His direct inspiration He has taught man that law is necessary in order to govern and regulate His own immediate interest and welfare: for this reason, that law is beneficial to promote peace and happiness among men. And as before remarked, God is the source from whence proceeds all good; and if man is benefited by law, then certainly, law is good; and if law is good, then law, or the principle of it emanated from God; for God is the source of all good; consequently, then, he was the first Author of law, or the principle of it, to mankind. (Joseph Smith, HC 2:12-13.)”

There’s something satisfying about the eternal nature of God; His being the same yesterday, today and forever. Rights and their meaning don’t change over time; they remain constant. What happens is a rationalization in order to pervert the meaning of those rights, a constant attempt to mitigate and marginalize the influence of God on our society.

The purpose of the Bill of Rights wasn’t to limit individuals; but to limit government and the never ending acquisition of powers by government which eventually infringes on individual God given rights.

But…there used to be a rule of grammar, something about starting a sentence with that word; …but God did place limits or parameters on the rights He gave all men. The Ten Commandments are still in place and all rights of man must be in perfect harmony as are all the laws of the universe. At no time do any of God’s laws or commandments contradict one already in place; and as I’ve pointed out in previous writings.

“There is a law, irrevocably decreed in heaven before the foundations of this world, upon which all blessings are predicated— And when we obtain any blessing from God, it is by obedience to that law upon which it is predicated.” Doctrine and Covenants 130:20, 21

In the case of freedom of speech, it is not natural, nor would it be correct to include profanity (or similar abominations) as one of the freedoms endorsed or permitted by God and yet our Supreme Court has perverted and extended the 1st Amendment to include almost any vulgar expression as if it were the same as those intended to be protected by God.

Nine black robed men have ruled to separate and restrict religion from the process of government, as if to declare our childhood relationship with God as having been completed. We, as a nation, have no further need of Him; an interesting point of view considering God is the Author of our liberty. Some folks awkwardly explain that our rights are inherent, that they are inalienable gifts from our Creator while the very same folks will argue the term Creator as recorded in our Declaration of Independence doesn’t necessarily refer to God; their attempt to extricate religion from the equation.

“If we are then to use the word inherent within the context of any discussion of rights then it must first be expressed somewhere, “From whom are we to inherit?” Who is it that has the ability to create such characteristics and to have the power necessary to propagate characteristics? Maybe I should restructure the question; In who’s image are we created after, that we might be heirs?”

Our right to peaceably assemble to address grievances has been marginalized for several years; but according to noted legal scholar Eugene Volokh after reading the Federal Restricted Buildings and Grounds Improvement Act of 2011, that legislation has not been employed in a restrictive manner and this latest version is not much different.

“…the new law is a slight modification to the existing 18 U.S.C. § 1752. Indeed, the broadest provision in the law — the special event of national significance provision — was added to the statute in 2006. Now it may well be that the law was a bad idea even then, but it strikes me as worth noting that the law has been in place for six years, through two administrations, without (to my knowledge) a vast amount of abuse.”

I respect Volokh’s opinion on legal matters; however, the fact remains this law, as were the older versions passed under previous administrations, this law is in direct conflict with the intent of the 1st Amendment’s purpose to keep government under the power of ‘We The People’ rather than the other way around. Government has usurped powers never intended and specifically denied it regardless of whether or not these powers are ever used against individuals voicing their concerns.

An article by Andrew P. Napolitano, an acknowledged constitutional law expert, wrote in the Washington Times regarding the lengths we are distancing ourselves from the intent to protect the right to address grievances against our government and those we’ve placed in positions of power.

“Last week (article written March 15, 2012), President Obama signed into law the Federal Restricted Buildings and Grounds Improvement Act of 2011. This law permits Secret Service agents to designate any place they wish as a place where free speech, association and petition of the government are prohibited. It permits the Secret Service to make these determinations based on the content of speech.

Thus, federal agents whose work is to protect public officials and their friends may prohibit the speech and the gatherings of folks who disagree with those officials or permit the speech and the gatherings of those who would praise them, even though the First Amendment condemns content-based speech discrimination by the government. The new law also provides that anyone who gathers in a “restricted” area may be prosecuted. Because the statute does not require the government to prove intent, a person accidentally in a restricted area can be charged and prosecuted, as well.”

Our founders were aware of the dangers of totalitarian rule in contrast with individual God given rights, having been dealt with condescendingly by the King of England. ( Is that an understatement or what?) Their intention was to limit the powers of government by expressing those limits in writing through the Bill of Rights which was added to our Constitution. Laws written in conflict with our constitutional form of government which remains on the books, whether enforced or not, can eventually be used to chip away at our God given rights.

It only takes one tyrant to turn our nation into a totalitarian dictatorship using existing laws and we may have found such a threat to our way of life in our current administration under Obama through the help of a rubber stamp Socialistic Senate, spineless Congress and a Supreme Court that lacks resolve to uphold the Constitution.

As individuals and citizens, while we are not required to acknowledge the source of our rights, that they come from our Father in Heaven, if we obey His commandments then we are entitled to the blessings of Heaven associated with acceptable behavior in the sight of God. It is not up to government to determine or limit God’s blessings; quite to the contrary, it is up to government to abide by the restrictions we have placed upon it.

Senator Chuck Schumer got one right; not that often I agree with what he says, “No amendment is absolute”. But; make no mistake, it isn’t government’s role to place limits on individual rights. God, in His wisdom, gave us our individual agency while at the same time He placed consequences which are attached to the rights of men long before our founders figured out a way to put those rights down in black and white.

As you prepare to celebrate this Independence Day please remember the awesome individual responsibilities which are linked directly with your rights, your God given rights. John Adams said the same basically the same thing.

“Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.”
