Natural Born Nonsense – Trump and Rubio’s latest gambit

Donald Trump, Marco Rubio and John McCain go to the citizenship card to derail Ted Cruz’ momentum

John McCain plays Marco Rubio’s Cat’s Paw in the latest desperation attempt to bring Ted Cruz down. Donald Trump is somewhere in the pile as well.

There has been a considerable amount of chatter regarding Donald Trump’s latest tactic in his ongoing scorched earth campaign, this time aimed at Senator Cruz’ campaign – in particular, the Senator’s legal qualifications to occupy the highest public office in the land. I refer to it as the NBC (Natural Born Citizen) flatulence.  Flatulence in case you don’t know, is a polite term for stinking the room up.

While Senator Cruz’ and his campaign have addressed this issue on numerous occasions (quite satisfactorily) – as far back as August 2013; the timing of this attack from the Trump campaign is curious to say the least. Trump is now behind Cruz in the Iowa Caucus polling. The raising of the NBC flatulence is obvious on the face of it as a cheap desperation move to attempt to derail Senator Cruz’ momentum.

I have good friends on Facebook, who subscribe to the NBC narrative and whom I have had spirited discussions with and we have agreed to amiably steer away from the subject. Now is one exception. I can only issue a cautionary note against hopping on the Trump and Rubio Bandwagon on this matter. Even if you don’t find Trump’s antics as disreputable as I do, please be aware that you will also have some other quite dubious political bedfellows.

The Obama White House is joining in the chorus, questioning Cruz’ status of eligibility! As I told a family member who brought this up this morning, my objection to Obama’s legitimacy as President, did and does not center around his father (whoever that may have been) or whether Obama was born on American soil. It centered around thelies, obfuscations, contradictory documents, possible forgeries and ongoing withholding of details of his background. Details that the American people are legitimately entitled to examine.

In embracing this NBC faux controversy, you will also be in the company of Senator John McCain  – who, by all appearances has worn out his welcome with Arizona voters and has, for the first time, some viable opponents lined up to term him out. McCain, who received a favorable interpretation of his own eligibility questions (having been born in the Panama Canal Zone), is acting as an “arms length” surrogate for his junior apprentice,Marco Rubio.  McCain was quoted as saying, “I think there is a question. I am not a Constitutional scholar on that, but I think it’s worth looking into. I don’t think it’s illegitimate to look into it.”

But it is illegitimate to “look into it” Senator McCain. It has already been “looked into” by an eminent bi-partisan team of Constitutional scholars, in a commentary, titled “On the Meaning of `Natural Born Citizen’ ” in Harvard Law Review, co-authored byPaul Clement, Solicitor General during George W. Bush’s second term, and Neal Katyal, a former acting solicitor general in the Obama administration and during the 2000 recount, co-counsel to Bush’s opponent, Al Gore. You can read their detailed argument and analysis, here – although the point of this article is not necessarily to win converts to what I consider to be an open and shut case for Senator Cruz’ eligibility bonafides.

For reasons that are obvious on closer examination, the NBC issue is not something Rubio’s campaign wants Marco to get embroiled in personally. Rubio is also a target of the NBC fetishists because he was born in the United States to parents, neither of which were U.S. Citizens at the time of his birth. You have not heard ONE word from me on Rubio’s status and beyond this brief reference, you won’t again. Because to borrow a phrase that John McCain is fond of using – it is “Wacko Bird” stuff.

Not only have Clement and Katyal, “looked into it”, but the non-partisanCongressional Research Service (CRS), has as well:

CRS, Nov. 14, 2011: The weight of legal and historical authority indicates that the term “natural born” citizen would mean a person who is entitled to U.S. citizenship “by birth” or “at birth,” either by being born “in” the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship “at birth.” Such term, however, would not include a person who was not a U.S. citizen by birth or at birth, and who was thus born an “alien” required to go through the legal process of “naturalization” to become a U.S. citizen.

And, to add to the roster, Fact Check.org., references Sarah Helene Duggin, a Catholic University law professor, who wrote in 2013 on the subject, “There is a strong argument that anyone who acquires United States citizenship at birth, whether by virtue of the 14th Amendment or by operation of federal statute, qualifies as natural born.”

I could add Theodore “Ted” Olsen, former Solicitor General, who defended a lawsuit contending John McCain was not “natural born”.  Mr. Olsen, a noted legal participant of the infamous Bush / Gore 2000 debacle, told National Review that “My conclusion would be that if you are a citizen as a consequence of your birth, that’s a natural-born citizen.”  Another respected Constitutional expert, this one with liberal leanings and personally favorable experience with Ted Cruz, Harvard Professor Emeritus Alan Dershowitz opined in National Review, “Of course he’s eligible.”

And of course, I ask the same question my friend Trevor Loudon asks on his blog,New Zeal:

Did the founding fathers really believe that any pregnant American woman who happens to be on holiday or business outside of America could be jeopardizing her child’s future chances of becoming the president of the United States?

Did they indeed? One fascinating analysis of that question, was credibly answered by a very respected Senior Fellow at the CATO Institute, Mr. Ilya Shapiroguesting on the “Doc” Washburn radio program. Among other things, Mr. Shapiro notes that Congress early on, had to revise or at least clarify the definition of “Natural Born Citizen” because the first 6, count ’em, 6 US Presidents were not born on United States soil – technically speaking, because when they were born the United States did not yet exist!

Shapiro also explains the later modification to the law that Congress instituted in 1952 –The Walker McCarran Act – or the Nationality Act of 1952, defining “Natural Born” and that after 1986, they widened the parameters even more. Ted Cruz, Mr. Shapiro notes, comfortably fulfills the requirements of that legislation. He also sheds more light than I’ve seen elsewhere on the “intent of the founding fathers”.

But you, should you hop aboard the NBC clownwagon, will also find yourself in the dubious company of one of the most unhinged, leftist Democrats in Congress, Florida House Member Alan Grayson, who has unabashedly equated the Tea Party to theKu Klux Klan and who has said that he intends to file suit in Federal court to challenge Senator Cruz’ eligibility. This from a man who terms Obama ‘Birthers’ as “loons”. No contradiction or inconsistency there unless you happen to have any degree of intellectual honesty and do not fit the profile of “partisan hack”.

If these uncomfortable bedfellows have not yet convinced you that you should leap from that flea ridden bed forthwith, perhaps the folks at the “National Society of Natural Born Citizens” will give you the “jolly old convincer”. Not only do they maintain a preposterous list of individuals past and present whom they deem ineligible to occupy the Oval Orifice, but they also are of the remarkable belief that:

An Amendment is necessary to provide the law necessary to provide woman eligibility to the Presidency. Woman (sic) are currently not eligible to the Office of President because they are not included in the definition of “natural born citizen and an Amendment is necessary to provide the law necessary for races other than European eligibility to the Presidency. Currently, only those of the European race are in the definition of “natural born citizen.” Congress needs to propose an Amendment to the Constitution that will provide the law necessary to provide other races eligibility to the Office of President. Congress is currently outside the law by accepting Electoral votes for a person not included in the definition of “natural born citizen.”

Did you catch that? European Race???? Only Whites and specifically White males are Constitutionally franchised to be elected to the office of the President of the United States? How do I double capitalize OMG?  Really, do you want to be thought of in the same frame of reference as these lunatic obsessives?

I trust the answer is no – at least I hope so.

Calls for #GunControl after Philly officer shot 3x by radical Muslim

Philadelphia Police Officer Jesse Hartnett was shot three times and suffered “some very serious injuries that will require multiple surgeries.” Amazingly, Harnett, a five year veteran of the force, managed to return fire as reported at CNN.

“Shots fired! I’m shot! I’m bleeding heavily!” Officer Hartnett was heard yelling on police radio.

CBS Philly reported:

“Philadelphia police commissioner Richard Ross says the officer, identified as 33-year-old Jesse Hartnett, was sitting in his patrol car around 11:30 p.m. at 60th and Spruce Streets when a gunman fired nearly a dozen shots through the driver’s side of the car.”

Shockingly, District Attorney Seth Williams was actually quoted as saying,

“I’m very thankful the officer is alive. This shows us the need for smarter laws when it relates to guns on the street.”

The suspect Edward Archer, 30, of Yeadon, who reportedly used a stolen police weapon, later said to investigators:

“I follow Allah. I pledge my allegiance to the Islamic State and that’s why I did what a did.”

According to Heavy, Archer told his mother that “police bend laws that are contrary to the teachings of the Quran.”

Not surprisingly, Philly.com initially reported that although the suspect was wearing “Muslim garb,” “…officials have not said if they believe religion was a factor.”

UPDATED: Updated article to reflect Heavy quote & that Archer reportedly used a stolen police gun.

GOP strategist Cheri Jacobus: Trump supporters should ‘feel shame’

Self-described “GOP consultant” Cheri Jacobus tweeted on Friday that Republican presidential candidate Donald Trump is “trying to mainstream abhorrent attitudes” such as “racism” and “white supremacy.” She further added that Trump supporters should “feel shame.”

Not surprisingly, Jacobus was not pleased with Donald Trump’s first campaign television ad:

“The ad is full of alarmism and fear-mongering,” Cheri Jacobus said as reported at kutv. She continues, “in addition to being downright disturbingly childish by using the phrase ‘until we figure out what’s going on’ as a part of the process of developing policy on terror.”

Jacobus appears to dislike Ted Cruz, as well. She re-tweeted someone saying that Ted Cruz is likely “unlikable and untrustworthy,” and then re-tweeted someone saying that establishment candidate Marco Rubio is “trustworthy:”

Jacobus’s sentiment is not new, as she slammed the conservative base as “low information” in August as reported at Breitbart during a Twitter exchange with John Nolte. At the time, Nolte observed:

Jacobus says she has been fighting for the GOP for three decades. Over these same decades, in 5 of the last 6 presidential elections, these genius consultants have consulted us to losses in the popular vote.

Without specifics of HOW Trump promotes white supremacist attitudes, Jacobus declares:

When the author asked Cheri to back up her statement with specifics, she was unable – of course – to rise to the challenge.

Cheri Jacobus’s bio at Politico declares in part that she is “a nationally-recognized political strategist, pundit and writer…”

This week’s winning essay, Joshuapundit’s Obama’s Gun Diktat – The Devil In The Details, is my take on what’s really behind President Obama’s new, unconstitutional diktat for what he calls ‘commonsense gun control’ – and why it’s a lot more far reaching and dangerous to our liberty than he’d like us to realize. Here’s a slice:

http://l.yimg.com/bt/api/res/1.2/z39TUdBBnp5kBPK1ANqlVQ--/YXBwaWQ9eW5ld3NfbGVnbztmaT1maWxsO2g9Mzc3O2lsPXBsYW5lO3B4b2ZmPTUwO3B5b2ZmPTA7cT03NTt3PTY3MA--/http://media.zenfs.com/en_us/News/ap_webfeeds/a94dbcadeb9cb2008c0f6a706700e48d.jpg

President Barack Hussein Obama has followed through on his promise to ‘go after guns’ via executive order and it was really quite a show. I especially liked the part where he started weeping crocodile tears over schoolchildren gunned down in Newtown, Connecticut in 2012.

“First graders in Newtown. First graders,” Obama said, pausing to collect himself. “Every time I think about those kids, it gets me mad.”

This concern for children from a man who fought tooth and nail for infanticide?  So touching.

At first glance, the president’s diktat on guns seems reasonable. Prog fascists are very good at that, and of course, the president was quick to use the usual progressive talking point  that everyone knows this is the right thing to do. Or to use his exact words, there’s what he called ‘a broad consensus’ supporting this, but those mean nasty Republicans in Congress just won’t act, so he has to.

The president admitted that his plan wouldn’t have stopped what happened in San Bernardino, but he feels this has to be done anyway, in order to ‘make if harder for criminals to get guns.’

I wish all the victims of the murders attributed to the President’s own efforts to put guns in the hands of criminals via Fast and Furious had been in the room, looking right at him when he said that. Now, their reaction would have been must see TV.

Before we discuss what the president has in mind, let’s get something out in the open. Prog fascists aren’t interested in getting guns out of the hands of criminals. They want confiscation of guns from the law abiding, because that’s the route to the absolute power they revel in. There’s nothing the president is proposing that’s going to get guns out of the hands of criminals, but it will make a lot of law abiding citizens helpless before them.

When you deal with a Barack Obama and those of his ilk, you have to realize that they play the long game. First, they propose something that sounds relatively reasonable, like say, ObamaCare where if you liked your plan, you could keep your plan…and just think of the savings and how cheap the premiums will be! Months later when the peons wake up down the road and realize how they’ve been lied to and screwed over, it’s too late to get rid of it without a major effort.

Please keep this in mind as we continue our discussion…Obama’s agenda never changes. When it comes to our pathological liar of a president, whatever he and his dutiful minions might say to grease something through has nothing to do with how it’s eventually applied. And the ultimate destination remains the same. In this case, it’s gun confiscation.

So with that said, let’s look at President Obama’s new diktat on guns. And remember, he’s tried to get this sort of thing through congress twice before and both times it has failed by bi-partisan majorities.

The first thing he wants is to promulgate that wonderful lefty myth, ‘the gun show loophole.’ The truth, as anyone who’s ever been to one can tell you is that it doesn’t exist.

If you go to a gun show, what you will see is licensed dealers,, because the people whom put on these things aren’t looking to go to jail for aiding and abetting illegal weapons transaction. If you see something on one of the dealer’s tables you like, they still are required to do a background check, the same as if you were in a brick and mortar store. All the laws, restrictions, waiting periods etc. all still apply. Also, as a licensed dealer in every state of the union you’re restricted to either selling guns at the registered address of your store or at an organized, licensed gun show. You can sell guns online out of state, but they must be legal in your buyer’s home state and they must be shipped to a licensed dealer in your buyer’s home state, where once again a background check has to be done and a waiting period imposed in accordance with the laws of the purchaser’s home state. Doing it any other way is a felony offense and not something a licensed gun dealer is going to risk prison and the loss of his livelihood for.

So the president talking about closing this fairy tale ‘loophole’ this means very little in and of itself and it certainly won’t keep guns out of the hands of criminals, but it fits in with the rest of the president’s agenda when it comes to convincing people who aren’t even aware of which end of a firearm points where that this is somehow necessary and important.

The next thing he wants, and the heart of his plan is to hire a lot more ATF and FBI agents to provide scrutiny on things like enhanced background checks. But remember two things; first of all, they work for President Obama and are going to do what he tells them to do – just like the IRS. And second, criminals don’t obtain firearms using methods where a background check is required. In the case of San Bernardino, the two killers and the friend that purchased additional firearms and explosives for them had no criminal record. And in the Newtown shooting, Adam Lanza likewise had no record, and got his weaponry by murdering his own mother in her bed. Not only that, but as I’ve pointed out before, the only reason any children died is because a school employee violated lock down procedure and let him in.

So if gun confiscation is the ultimate aim, criminals aren’t really a very productive target. To really confiscate as many guns as possible, you have to go after the law abiding and somehow transform them into people who shouldn’t be allowed to own firearms to defend themselves. And the best way is to work the ‘mental health’ and the enhanced background check angles, the really devious parts of Obama’s plan.

Doctor-patient confidentiality? Faggedabboudit. Health and Human services rules have now been changed to put the onus on physicians to report anything you tell them that seems even slightly amiss to the FBI or the ATF. And what doctor is going to take the risk of potential liability by not doing so? No matter how minor or what the cause is, just a report from your physician that you seemed slightly depressed or not your usual self can ultimately be used to confiscate any guns you own.

And you can trust states ruled by ‘progressives’ to take this even further. California just put a law into effect requiring physicians to ask patients if they own guns, which guns they posses and where they keep them. Failure to answer alone is grounds for the doctor to report this to the FBI or the ATF, and a doctor can even order your guns seized by court order if he really wants to cooperate with the State. After all, if he doesn’t and something happens…do I need to draw you a picture? We could even be talking about criminal liability here, or forfeiting a license to practice. Fear of government is the meat prog fascists thrive on.

VA will also be a fertile grounds for this. Veterans, after all, can all be labeled victims of PTSD, mental stress, maladjustment to peacetime society, call it what you want. The psycho veteran beloved of Hollywood scriptwriters has become a cliche these days. And these are men and women who likely own firearms and have been trained to use them. You can expect them to be heavily targeted for confiscation by the Regime.

What about victims of lawfare? A spurned girl friend can accuse a man of sexual assault, claim he threatened her and/or file a police report with no proof at all except her word. Thanks to VAWA, a woman can even have a man locked up with no real evidence at all, or say that self inflicted bruises were the result of assault or domestic abuse. Any family law attorney or criminal lawyer will tell you that this sort of thing happens with disturbing frequency nowadays. That’s especially true when it comes to divorce cases, particularly where child custody is involved. And even if its proven that the accusation is totally unfounded, it remains on the record. Goodbye Second Amendment rights!
